Mohammedan move to Court against AIFF

Mohammedan Sporting have taken a legal route by moving to Calcutta High Court against the All India Football Federation (AIFF) on Wednesday regarding the governing body's over to allow their Tolgay Ozbey to play against them."We have filed a case yesterday in the Calcutta High Court. I, as the assistant general secretary of the club, have filed the case on behalf of my club against AIFF for breaching their own regulations," Istiaq Ahmed (Raju) informed Goalon Thursday.
“The player is at liberty to sign and play for any other club of his choice, but cannot play any matches in any tournament against our club for season 2013-14,” read point three of the termination clause between Ozbey and Mohammedan.
“The above is subject to realisation of cheques,” it further adds.
Mohammedan owed Ozbey over 400000 INR. This was despite the player honouring his part of the agreement by not playing against the Black and Whites in the Federation Cup back in January.
“Mohammedan Sporting had a clause in his exit contract which disallowed him to play against Mohammedan in the current season. However, after intervention of AIFF, it was decided by the apex body to allow Tolgay Ozbey to play against his former employers," Dempo SC had issued a statement on the eve of the said game.
"They are violating the laws they have set themselves. The I-League regulation says that they will not interfere in a deal between the club and the player and now they have done that only. That was illegal from and that's why we have decided to take the matter to court," said Ahmed."We have informed the court that we had also appealed to the AIFF to alter the decision, but no decision was taken. Now, with the next season drawing close, we will request to give an early verdict so that we can stay out of the relegation zone and have our plans for the next season in place. There are 14 parties involved in total. Tolgay Ozbey, Dempo Sports Club are certainly among them," he added.
The next hearing of the case will be on 14th May.
